We have just been informed by the owners lawyers, that they will sell
the dock to the highest bidder on the 29th January 2009. Please read the
tender procedure below and let me know if you are interested.
On behalf of the owners (the bank), the lawyers proposes a tender procedure:
For the purpose of a final safe of the dock, the bankruptcy estate has
decided to invite all potential purchasers to participate in a tender procedure.
To participate in the tender procedure your offer must be received by the
undersigned no later than 29 January 2009 at 12.00 a.m., and the offer
must include the following information?s:
- The offered purchase price based on cash payment
- Acceptance of the offer being binding for a period of minimum 2
weeks from the final deadline
- Information about any commission the bankruptcy estate must pay lo accept your offer
- The date where the dock is taken over by the purchaser. The date must not be later than 28
February 2009
The offer must not include reservations of any kind.
In immediate continuation of the deadline on 29 January 2009 the
bankruptcy estate will inform you whether your offer has been accepted.
The bankruptcy estate reserves the right to a free choice between the
incoming offers, and the bankruptcy estate is not obligated to accept any of' the incoming offers.
